  • Project Information: Photos of your property (roof, exterior, etc.), measurements, and service history.
  • Communication Records: Logs of SMS messages, emails, and phone calls.
  • Payment Information: We use secure third-party processors (like Stripe via Jobber). We do not store your credit card or bank account details on our own servers.

2. SMS / Text Messaging (DPN Compliance)

By providing your mobile number, you agree to receive text messages from South Texas Roofing LLC regarding appointments, project updates, and invoicing.

  • Consent: Your consent for SMS is obtained via website forms or verbal agreement. We do not share your SMS consent with third parties for marketing purposes.
  • Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to our number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed.

  • Rates: Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply.

3. Use of Project Media (Photos/Videos)

We routinely take "Before, During, and After" photos and videos of our projects to document work quality and for marketing purposes.

  • By engaging our services, you grant South Texas Roofing LLC a non-exclusive, royalty-free license to use images of your property (excluding any identifiable personal likeness or street numbers where possible) for our website, social media (Facebook/Instagram), and promotional materials.
  • If you wish to opt-out of having your project photos used for marketing, please notify us in writing.

4. How We Share Your Information

  • Service Providers: We share information with Jobber (our business management software) and our material suppliers to facilitate your project.
  • No Sale of Data: We do not sell, rent, or lease your personal data to third parties.
  • Texas Privacy Rights: In accordance with the Texas Data Privacy and Security Act (TDPSA), you have the right to request access to, correction of, or deletion of your personal data.

5. Data Security

We use industry-standard safeguards, including those provided by Jobber, to protect your information from unauthorized access. However, no method of transmission over the internet or electronic storage is 100% secure.

TERMS OF SERVICE

1. Scope of Work

South Texas Roofing LLC (the "Company") agrees to provide roofing services as specified in the signed written estimate or proposal. Any changes, "add-ons," or deviations from the original scope must be agreed upon in writing and may result in additional charges.

2. Payments and Deposits

  • Deposit: A deposit (typically 10-33%) may be required before materials are ordered or work commences.
  • Final Payment: The remaining balance is due immediately upon substantial completion of the project.
  • Late Fees: Payments not received within 7 days of completion are subject to a late fee of 1.5% per month on the outstanding balance.

3. Homeowner Preparations

To ensure a safe and efficient job site, the Customer agrees to:

  • Move vehicles away from the driveway and garage.
  • Remove fragile items from interior walls and ceilings (vibrations can cause items to fall).
  • Ensure pets and children are kept away from the work zone.
  • Access: Provide access to exterior power outlets and water faucets.

4. Weather and Scheduling

South Texas weather can be volatile. The Company reserves the right to delay or reschedule work due to rain, high winds, or extreme heat to ensure crew safety and roof integrity. The Company is not liable for damages caused by "Acts of God" (e.g., a sudden tropical storm) during the construction process, provided reasonable dry-in measures were taken.

5. Insurance Claims

If the work is being funded by an insurance claim, the Customer is responsible for the full contract price.

  • Deductibles: Per Texas law (HB 2102), it is illegal for a contractor to waive or "absorb" a homeowner's insurance deductible. The Customer must pay the deductible in full.
  • Supplements: If the Company discovers additional damage not covered in the original insurance estimate, the Customer agrees to allow the Company to file a supplement with the insurer.

6. Materials and Unexpected Repairs

  • Decking/Plywood: If rotted wood or "bad decking" is discovered after the tear-off, the Company will replace it at a pre-negotiated rate per sheet/linear foot.
  • Matching: While we strive for a perfect match, the Company cannot guarantee that new shingles will perfectly match existing ones due to weathering and manufacturer dye-lot variations.

7. Warranty and Liability

  • Workmanship: We provide a [Insert Number, e.g., 5-year] limited warranty on labor. This does not cover leaks caused by animal damage, foot traffic, or extreme weather (hail/hurricanes).
  • Manufacturer Warranty: Material defects are covered by the manufacturer (e.g., GAF, Owens Corning).
  • Interior Damage: The Company is not responsible for dust or small debris that may fall into the attic or garage during the replacement process.

8. Texas Law and Disputes

This agreement is governed by the laws of the State of Texas.

  • RCLA Notice: This contract is subject to Chapter 27 of the Texas Property Code. The Customer must provide notice of any construction defects at least 60 days before filing a lawsuit.
